ENFORCEMENT SECTION
 
 
The role of the Enforcement Section is to enforce EU and national road transport legislation on tachographs, driver’s hours rules, Working Time Directive and licensing of road haulage and passenger operations.

This section provides information on the following:-
EU legislation dealing with tachographs and driver’s hours rules follows:-
Tachograph equipment

COUNCIL REGULATION (EEC) 3821/85 on recording equipment in road transport.  This Regulation sets down the requirements in relation to the technical specifications, fitment and use of tachographs
 
COUNCIL REGULATION (EC)  2135/98 amending Regulation 3821/85 which introduced digital tachographs
 
COMMISSION REGULATION (EC) 1360/2002 – this sets out the actual technical specification for digital tachographs (sometimes referred to as the Annex 1B Regulation).  This is a large document which takes a few minutes to download
Driver’s Hours rules
 
COUNCIL DIRECTIVE (EC). 2006/22 on minimum conditions for the implementation of social legislation relating to Road Transport
 
REGULATION (EC). 561/2006 sets down the rules on driving time, breaks and rest periods for drivers.
 
COUNCIL DIRECTIVE. 2002/15 on the organisation of the working time of persons performing mobile road transport activities

Important Note for Drivers/Operators of buses and goods vehicles – you are required in Ireland and other jurisdictions to account for gaps in driving time records arising as a consequence of sick leave, annual leave or periods when you are driving another vehicle exempted from the scope of Regulation No. 561/2006. A form of Attestation 1 for this purpose which is recognised in all EU Member States  must be completed prior to embarking on the journey.

Your information helps Euro Contrôle Route to get a better understanding of the enforcement of the European regulations on driving and rest times, and possible pressure points in their enforcement. With the aid of your information, Euro Contrôle Route is drawing up an inventory of these pressure points and passing this information on to the countries.
